In today’s world, an intellectual product, brand, or invention is an asset as valuable as capital. Failure to protect these assets can lead to the loss of years of labor within weeks.
Trademark and Patent Law provides the legal ground that ensures the protection of intellectual effort. In Turkey, this field is regulated under the Industrial Property Law (SMK) No. 6769. This law covers trademarks, patents, utility models, designs, geographical indications, and trade secrets.
At SVK Law, with our offices in Izmir and Bursa, we manage our clients’ intellectual assets both during the registration phase and in protection processes against infringement.
The registration of a trademark is not only about protecting a name or logo; it is also about securing commercial reputation and investment. The Trademark Registration process proceeds as follows:
Search: Examination of similar trademarks before application (preliminary research report).
Application: An application is made to the Turkish Patent and Trademark Office (TURKPATENT).
Bulletin Publication: The application is published in the TURKPATENT Bulletin, and a 2-month opposition period begins.
Registration: If there is no opposition, the trademark is registered and protected for 10 years.
SVK Law conducts the process on behalf of the client, from pre-application similarity analysis to the opposition and registration process.
Trademark rights ensure the protection not only of registered trademarks but also of well-known marks. Unauthorized or similar use of a trademark is considered trademark infringement (marka hakkına tecavüz) (SMK Art. 29).
Lawsuits that can be filed in this case:
Action for Cessation of Infringement (Stopping the violation)
Compensation Lawsuit (Pecuniary + Non-Pecuniary)
Criminal Action with a request for Seizure and Confiscation
Preliminary Injunction and Determination of Evidence
SVK Law ensures the documentation of the violation by conducting a determination of evidence before the lawsuit. We also provide digital evidence determination services for trademark infringements on online platforms (e.g., e-commerce sites).
Patent registration is required to protect an invention. A patent grants the owner the exclusive right to use and produce for a certain period.
Difference Between Patent and Utility Model:
| Feature | Patent | Utility Model |
| Protection Period | 20 Years | 10 Years |
| Novelty Level | High (Inventive Step required) | Lower |
| Examination Process | Mandatory / Substantive | Simplified |
| Example | A completely new machine system | An improved version of an existing product |
Patent infringement can occur through unauthorized production, sale, import, or use. In this case, the patent owner can file both criminal and compensation lawsuits.
Not only the idea but also the design reflecting the idea is legally protected. Design Right protects features of a product such as shape, line, color, or surface texture.
SVK Law conducts the registration of industrial designs before TURKPATENT and develops defenses against unauthorized copying by third parties.
Additionally, copyright lawsuits are conducted within the scope of the Law on Intellectual and Artistic Works No. 5846 to protect the moral and financial rights of the author.
Trademark or patent infringement is often seen together with trade secret violation. According to Article 54 and following of the Turkish Commercial Code, any act constituting unfair competition (imitation, misleading promotion, damaging commercial reputation) is subject to litigation.
SVK Law makes urgent applications for immediate injunction decisions, especially in unfair competition files between rival firms.
Trademark and patent protection is not limited to the borders of Turkey. To protect our clients’ rights abroad, international applications are made via:
Madrid Protocol (for Trademarks)
PCT – Patent Cooperation Treaty (for Patents)
SVK Law manages the process by cooperating with authorized patent attorneys in foreign registration processes.
It concludes within an average of 6 to 9 months from the application. However, if there is an opposition, this period may be extended.
Yes, but an unregistered trademark is not under full legal protection. Using it before filing can be a subject of defense as “prior use right” in the future, but it is risky.
A defense must be submitted to TURKPATENT within 1 month against objections. If the defense is rejected, a lawsuit can be filed against the decision at the Ankara Civil Court for Intellectual and Industrial Rights.
Annual renewal fees (annuities) must be paid after the patent application. Otherwise, protection ends automatically.
Yes. If there is a design registration, a design infringement lawsuit can be filed; if there is no registration, unfair competition provisions apply.
It is determined according to the scope of the damage; the court usually calculates based on lost profit + damage to reputation + gain from production.
No. However, if you use your brand abroad or export products, protection under the Madrid Protocol is recommended.
