Is it mandatory to hire an attorney?

Under Turkish law, hiring an attorney is not mandatory for most cases. However, many legal processes require technical knowledge, procedural expertise, and strategy. A wrong petition, missing a deadline, or a procedural error can lead to a loss of rights. Therefore, getting support from an expert attorney is generally the right choice.

Yes, you can file a lawsuit on your own behalf. However, many situations in the legal system are subject to strict procedural rules; incomplete or incorrect actions naturally lead to the dismissal of the case or unfavorable results.

Attorney fees are determined based on many factors such as the nature of the case, the degree of difficulty, the volume of work, and the status of evidence. Additionally, a fee agreement can be made based on the Minimum Wage Tariff of the Union of Turkish Bar Associations.

An attorney fee agreement defines the rights and obligations between the client and the attorney. With this contract, elements such as the fee, the scope of work, and the duration are clearly written. This reduces the possibility of future disputes.

To revoke a power of attorney, a “letter of dismissal” (azilname) is usually issued via a notary public and notified to the relevant authorities. After the dismissal process is completed, the attorney can no longer perform transactions with that power of attorney.
